Chihuri threatens Tendai Biti

Police Commissioner Augustine Chihuri has threatened MDC secretary general Tendai Biti with unspecified action when he returns to Zimbabwe. He accused him of illegally declaring results of the March 29 2008 elections and “urging and abetting political violence”.

agustine-chihuri.jpgThree days after the Elections Tendai Biti announced the Presidential poll projection provided by the Zimbabwe Election Support Network that showed Tsvangirai received 47.0 to 51.8 of the vote and Robert Mugabe 39.2 to 44.4. The Margin of Error was 2.4. State media and some foreign media have since seized on 47.0 and ignored 51.8 to say he failed to win an absolute majority.

Chihuri had implied in his letter that Biti announced the actual results.It has since emerged that Justice Minister, Patrick Chinamasa who lost Makoni Central parliamentary seat yesterday reportedly told a South African paper that the actual results are that Morgan Tsvangirai won with 47% and Mugabe got 43% and those results were provided to South Africa’s President Thabo Mbeki and also distributed to SADC leaders.

Of note is that on the weekend following the election,Robert Mugabe ’s spokesman wrote in The Herald that the initial presidential results were wrong and MDC candidate Morgan Tsvangirai according to George Charamba had 50% of the vote enough to avoid a runoff,but Charamba said that result was rigged and needed to be “corrected”.

‘Which is why there was a bit of desperation to stampede both Government and ZEC into announcing faulty results that would have rigged Tsvangirai into an outright win.” He said.

What followed the article’s publication were developments reported in the Metro that the government had taken over the functions of the Zimbabwe Electoral Commission(ZEC) recounts in 23 constituencies were announced,ballots boxes were taken to an unspecified location,Observers and MDC chief election agents were excluded from the whole process until on Thursday this week.

The MDC has since provided its set of results that it says was collected after polling they show Morgan Tsvangirai with 51.7% of the vote. The results concur with those projected by the Zimbabwe Election Support Network,an independent body it projected Tsvangirai could have got 51.8 of the vote and Robert Mugabe 44.4.

Chihuri ’s Letter

On Wednesday Chihuri wrote a politically charged letter to Biti and was circulated to the press and Metro obtained a copy and has since confirmed that it has not been delivered to the MDC Secretary General or his office at Harvest House on 44 Nelson Mandela Avenue.

Exceprts:

“What is very conspicuous in the Zimbabwean political arena today is your prominent role in urging and abetting political violence through unbridled rhetoric of incitement.

“You know for sure, your violation of the country’s laws by declaring presidential results which was, in deed, in contravention of Section 110 of the Electoral Act, Chapter 2:13 and is still to be attended to by the police.

“Maybe, this you may cite as having been a deliberate delay in bringing the culprit to book, but as all know, the swift arm of the law will always catch up with the evildoer”

“Surely, the police have been looking for you so that you could assist in investigations surrounding the above-mentioned issue, concerning the electoral laws and other matters, but you were nowhere to be found.

“The only time one sees you is on the international media, making all sorts of unsubstantiated allegations against everybody else and the country, gallivanting all over the world. This might be the reason why you are out of touch with the real issues affecting the people on the ground.”

“Unfortunately, Honourable Biti, your intention to set a malicious political agenda against the Zimbabwe Republic Police by unnecessarily dragging it into your political skirmishes cannot be hidden anymore.

“No threats of any kind, manner and fashion shall deter me as the Commissioner-General of Police and leader of the Zimbabwe Republic Police to strongly act against any orgy of violence from any quarter in this country.

“I nevertheless urge you to take a leading role in condemning public violence, stop harbouring criminals at your party headquarters and publicly disband the so-called Democratic Resistance Committees, which have become a real menace to our peace loving citizens, since March 11, 2007.

“Let me hasten to say that I seriously view your allegations as an unacceptable political gimmick, in which I should as a matter of principle, register my uttermost disaffection and dismay, more so as it comes from a person of your standing, who has been a member of the legislature for a considerable number of years.

“I wonder why you should play political games with issues of this nature, issues that concern the security of this country and its citizens”

“However, culprits of various criminal activities including those involved in the recent failed MDC initiated stay-away were arrested and taken to courts for prosecution throughout the country.

“Should you be so willing to find more facts surrounding the disposal of these cases, I do hereby advise you to visit the courts and check with their records, which are public records in any case”.

  1. I thought they were saying those MDC was not telling the true results.

    If Biti is not telling the true results, then how can Biti be charged with releasing the results?

    Furthermore, I don’t see anything in the language of Section 110 of the Electoral Act, Chapter 2:13 that even remotely indicates that it’s illegal for someone else besides the Cheif Electoral Officer to announce the results before ZEC announces it.

    110 Determination and declaration of result of election to office of President

    (1) Where only one candidate for President is validly nominated at the close of the day
    on which a nomination court sits in terms of section 38(1)(a), the Chief Elections Officer shall
    declare such candidate to be duly elected as President without the necessity of a poll.
    (2) Where two or more candidates for President are validly nominated, a poll shall be
    taken in each constituency for the election of a President.
    (3) Where two or more candidates for President are nominated, and after a poll taken in
    terms of subsection (2) no candidate receives a majority of the total number of valid votes
    cast, a second election shall be held within twenty-one days after the previous election in
    accordance with this Act.
    (4) In a second election held in terms of subsection (3) only the two candidates who
    received the highest and next highest numbers of valid votes cast at the previous election shall
    be eligible to contest the election.
    (5) If, after a second election held in terms of subsection (3), the two candidates referred
    to in subsection (4), receive an equal number of votes, Parliament shall, as soon as
    practicable after the declaration of the result of that election, meet as an electoral college and
    elect one of the two candidates as President by secret ballot and without prior debate.
    (6) The result of an election to the office of President held in terms of subsection (2) or
    (3) shall be declared by the Chief Elections Officer who shall forthwith publish such result in
    the Gazette and in such other manner as he or she considers necessary to give sufficient
    publicity to the result.
    (7) Notwithstanding subsection (5) of section 23 of the Constitution, a person elected as
    President in terms of subsection (5) shall assume office on the day upon which he or she is
    declared so elected by the Chief Elections Officer.
    (6) The procedure for an election in terms of subsection (5) shall be as prescribed.

  3. I am surprised at the reaction of the media world wide….why are they so desparate for a story on zimbabwe? The presidential results have not been announced yet-verification is today..what do we get? High ranking zanu pf minister has apparently said morgan got 47 and mugabe 43-makoni is not even mentioned.

    The results that the media should wait for are ZEC results otherwise you shall suffer with gossip and lies. Why dont you say the name of the high ranking minister? If its not fact then dont talk about it-journalism as a proffession is dead and buried..

    I can understand why Mugabe barred some of these from covering zimbabwe..these journalists are no different from biti .

  8. This is a true sight of the real confusion in that sad country. Its just a country where only the rich under the Mugabe regime sing songs of praise. People talk about peace? I daught if any of them can really define what that word mean. Zimbabwe knows no peace. Yes, we cant run away from the fact that Mugabe liberated that country, but lets not run away also from tha fact that he has done more damage than any good to it. This Chihuri guy sounds just like a traped monkey that has ran out of ideas. He is just trying to twist that straight forward Electorol Act to suit his persue his twisted goals in the name of the law.That Act does not say people must not PROJECT election results. Is projecting election results in Zimbabwe a crime? If so, then he must be having a case. But on the Electoral Act it does not say anything like that.

    This is just a ploy by Mugabe to try to stop Biti from going to Zimbabwe to campaign for the runoff elections. They are trying to just stop Biti and Tswangirai form going back to Zimbabwe to campaign for the run off.

    Zimbabwe is being reduced to nothing by people once considered ite heroes. Cry the beloved country!!!

    if it makes no sense to you dont get angry -just say your side of the story. all the people you se contributing articles here care about their country-they just have different ways of saying it…for various reasons.

    Debate on zimbabwe is good-in business its called brainstorming-others will come up with silly ideas but you do not insult them but encourage positive thinking .some of the silly ideas will turn out to be the ideal ones…enough on that!!

    Now where do we go from here now that the results are out? What do you want the mdc to do-im saying mdc as a party-not morgan. We attach too much power to these people no wonder they end up as dictators. The party should come first.

    In this case do you think you should take part in a run off? If not then what do you want to do? We are fed up of hanging about.My opinions matter so dont insult me.Just deal with the issues i have raised in a proffessional manner.

    some times people have the tendency to get angry if they encounter difficult questions-no just say your side of the story.If my argument is not right then say why you think so and put your point across…

    At this point i want to thank each and every zimbabwean for your efforts in a non violent solution to our problems as some seem to be praying for. Just know that at the end of the day black on black will not be tolerated in zimbabwe.when the real enermy emerges we will fight-we have been there before.

    Every other country is praying for a kenya or rwanda in our country-we say no to that as we are a caring community.we have lived like this for the past 28 yrs bar a few spats.We have proved to the rest of the world that we are educated and practice democracy in its truest form-not blood bath.

    zimbabwe is a peaceful nation-we are not for sale.

Find out the cause and enjoy the same support. remember one thing in a home if the father is penniless female children resort to prostitution .

    Richard, just go home and find out if your relative havent been affected but this new ZANU PF violent campain. Maybe your houses got torched just like what is happening all over the country.
